As part of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, before you file for bankruptcy relief, you must take a credit counseling course.
This is a onetime class which you may take over the phone, online or in person. The certificate you receive following the course is good for 180 days before you file your bankruptcy case.
Except in very limited situations, everyone must complete the credit counseling course. Generally upon completion a copy of your Credit Counseling Certificate will be sent to your bankruptcy attorney either via email and/or fax. Your bankruptcy attorney will then file your Credit Counseling Certificate at the same time she files your bankruptcy petition and schedules.
The organizations that provide Credit Counseling must first be approved by the Department of Justice’s U.S. Trustee Program. It is always wise to make sure that organization that you want to work with appears on the Department’s approved list –for your jurisdiction– before taking your course. The credit counseling organization that you choose will evaluate your personal financial situation, discuss possible alternatives to bankruptcy, and review your personal budget. You should expect your session to last around one hour.
The agency you choose should discuss any fees associated with their service with you prior to starting the counseling session. There is a wide range of fees between the different organizations. However, no agency is allowed to charge an extra fee for your certificate.
